Banking mediation charter of the Crédit Agricole Provence Côte d´Azur

The Caisse Régionale de CREDIT AGRICOLE PROVENCE COTE D´AZUR is inventing the first personalised bank for everyone, and is dedicated to a movement involving easy access, listening, advice and conciliation. The Caisse Régionale is eager to favour out-of-court settlement of disputes with its customers, and proposes that you send your complaints to your branch, to the Customer Relations Department, or to the mediator designated under the conditions below.

Article 1 - Choice of the Mediator
The Mediator designated by Caisse Régionale de Crédit Agricole Provence Côte d´Azur is a competent outside person, who is independent of Credit Agricole, qualities that are required for purposes of impartiality in the handling of disputes.

Article 2 - No charge
Mediation is free of charge for the customer.

Article 3 - Scope

3-1 - Disputes concerned The mediator may handle referrals to consider disputes with individuals who are not acting for business purposes with regard to the services supplied and the performance of the contracts entered into under Chapters I and II of Book II of the French Monetary and Finance Code and concerning the products stated in Chapters I and II of Book III of that same Code: financial instruments, savings products, banking transactions, investment services and allied services.

3-2 - Disputes excluded The Mediator cannot, unless agreed otherwise by both parties, handle a matter if it has been referred to the courts to settle the dispute between the litigants. Matters that are excluded include disputes arising out of the bank´s sales policy (pricing policy, commercial range, consent to credit, etc.).

Article 4 - Role of the Mediator
The Mediator´s assignment is to work towards an amicable agreement concerning the matters referred to him/her, particularly be making recommendations. The client and the Caisse Regionale are not obliged to accept the Mediator´s recommendations. The Mediator is the master of the conduct of his/her assignment to achieve the goal of conciliating the parties. He/she will ask the customer and the Caisse Regionale for all documents and/or remarks that he/she deems useful for the fulfilment of his/her assignment. He/she may, if he/she so desires, hear them separately, and they may even be assisted by Counsel.

Article 5 - Referral to the Mediator: Procedures
In the event of a dispute arising out of Article 3.1 : Disputes concerned, you have the possibility of applying at no charge to a Mediator whose contact details are shown on your account statements. Referral to the Mediator constitutes the Customer´s agreement to the terms of this Charter. Acceptance is effective as of the date of receipt by the Mediator of the referral form sent by mail. As required, the Mediator will send you a document enabling you to outline the purpose of your complaint and will outline to you the next stages of the procedure. You are able to learn about the progress of this process, either in a branch or on the website of your Caisse Regionale under the heading “Legal Information / MEDIATION CHARTER". Referral to the Mediator suspends any court proceedings that are under way.

Article 6 - Confidentiality of exchanges
The Mediator is required to keep all information strictly confidential: the statements and representations of the customer and of the Caisse Regionale may not be produced, or referred to, following the process, unless both parties so agree. Persons who, with the explicit consent of the parties, may assist them or participate in the meetings are subjected to the same duty of confidentiality.

Article 7 - Lifting of banking secrecy
The customer explicitly authorises the Caisse Regionale to provide the Mediator with all the documents and information that may aid in the fulfilment of his assignment. The customer releases the Caisse Regionale from banking secrecy concerning him/her for the purposes of the MEDIATION. In general, each party undertakes to provide the Mediator with all documents and information he/she may seek, without delay.

Article 8 - Term of the Mediation
The term of the mediation will not exceed two (2) months as of the date on which the matter is referred to the Mediator. Once the Mediator´s recommendations are made and if the two parties fail to agree, they shall be free once again to pursue their rights. This referral suspends all time constraints during the term of the MEDIATION. This referral to the Mediator therefore is not a hindrance to conservatory measures that the Caisse Regional may take during the mediation.

Article 9 - Report of the consent of the Customer and of the Caisse Regionale
If they customer and the Caisse Regional agree to the Mediator´s recommendations, the parties will jointly sign an agreement or a settlement under the aegis of the Mediator, which will not be disclosed to anyone whatsoever, except for the purposes of its enforcement. The settlement or agreement will constitute abandonment of legal case and court action concerning the difficulties so settled. Lack of response to the recommendations that are served upon the customer and the Caisse Régionale for more than 30 days, will constitute rejection of the proposals made to them by the Mediator.
